Nothing in these terms excludes, restricts or modifies any non-excludable consumer guarantee under the Competition and Consumer Act 2010 (Cth). Where a breach of a non-excludable guarantee occurs, Merivo’s liability for such breach is limited (at Merivo’s election) to the supply of the relevant services again or the payment of the cost of having those services supplied again.
